Gun Control
Should there be more restrictions on the current process of purchasing a gun?
The Constitution clearly states "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." The President, Senators and Representative all swear an oath to defend the Constitution. Any Federal law limiting gun ownership (enacted or proposed) would be in clear conflict with the 2nd Amendment. By even proposing any law to control guns, our elected officials, by definition, would be breaking their oath of office.
The only legal way for the Federal government to restrict gun ownership is to first repeal the 2nd Amendment. Any federal laws restricting gun ownership would be in conflict with the Constitution and the Bill of Rights. Gun control, in the absence of any change to the Constitution, is an issue that can only be legally addressed on a state and local level.
The only legal way to enact gun control legislation is to respect the U.S. Constitution and the Constitutions of each of the individual states. If gun control is to be enacted legally, the issue must be addressed by amending the Constitutions of the individual states.
Most individual states also have Constitutional guarantees regarding the right to bear arms. The following states do NOT:
We agree with the 2016 Democratic Party Platform:
"With 33,000 Americans dying every year, Democrats believe that we must finally take sensible action to address gun violence. While responsible gun ownership is part of the fabric of many communities, too many families in America have suffered from gun violence. We can respect the rights of responsible gun owners while keeping our communities safe."
We agree with the 2016 Republican Party Platform:
"We uphold the right of individuals to keep and bear arms, a natural inalienable right that predates the Constitution and is secured by the Second Amendment. Lawful gun ownership enables Americans to exercise their God-given right of self- defense for the safety of their homes, their loved ones, and their communities."
We agree with the 2016 Libertarian Party Platform:
"We affirm the individual right recognized by the Second Amendment to keep and bear arms, and oppose the prosecution of individuals for exercising their rights of self-defense. We oppose all laws at any level of government restricting, registering, or monitoring the ownership, manufacture, or transfer of firearms or ammunition."
We agree with the 2012 Constitutional Party Platform:
"We call for the repeal of all federal firearms legislation, beginning with Federal Firearms Act of 1968.
We call for the rescinding of all executive orders, the prohibition of any future executive orders, and the prohibition of treaty ratification which would in any way limit the right to keep and bear arms."
